Terms of Service

Acceptance of Terms

By accessing or using TestHawk, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service.

If you are using TestHawk on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

The Service

TestHawk provides automated website quality assurance scanning. The service:

• Crawls URLs you submit and analyzes pages for issues across accessibility, SEO, security, performance, and functionality.
• Generates reports with findings, severity ratings, and health scores.
• Delivers reports via the dashboard, email, and webhook integrations.
• Supports scheduled recurring scans for paid accounts.

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

Acceptable Use

You may use TestHawk only for lawful purposes. The following are prohibited:

• Unauthorized scanning — scanning websites without the authorization of the site owner. You must have the right to test any URL you submit. TestHawk respects robots.txt directives and rate limits, but the presence of these does not constitute authorization.
• Abuse and rate evasion — attempting to circumvent fair-use limits, creating multiple accounts to gain additional free scans, or otherwise abusing the free tier.
• Harmful or deceptive content — using TestHawk to scan for or generate content that is harmful, illegal, or deceptive.
• Reverse engineering — attempting to reverse engineer, copy, or extract the proprietary logic of TestHawk.
• Data misuse — using scan data for purposes other than improving the website you submitted for scanning, or sharing results in a way that misleads others about their origin.

Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account, including URLs submitted for scanning.
• You must be at least 18 years old to create an account.
• One person or entity may not maintain more than one free trial account.
• Report any unauthorized use of your account immediately at security@testhawk-2.polsia.app.

Billing & Payments

• Subscriptions — paid plans are billed monthly or annually in advance. Annual plans offer a discount.
• Free trial — new accounts get a 7-day free trial of Pro features. No credit card required to start the trial. Your card is charged only if you actively upgrade.
• Cancellation — you may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
• Refunds — monthly plans are non-refundable. Annual plans may be eligible for prorated refunds if canceled within 14 days of renewal, at our discretion.
• Failed payments — if a payment fails, we will notify you and attempt to retry. After 14 days of failed payment, your account may be downgraded to the free tier.
• Price changes — we will notify you by email at least 30 days before any price change takes effect.

Payments are processed securely via Stripe. TestHawk does not store your card details.

Service Level & Accuracy

• Scan accuracy — TestHawk uses automated analysis. Results are generated by heuristics and may not catch every issue, may occasionally flag false positives, and may miss issues that require human judgment.
• Uptime — we strive for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance and unexpected outages may occur.
• Report currency — scan reports reflect the state of the scanned URL at the time of the scan. Pages change frequently; reports may become outdated.
• Accessibility compliance — scan results are not a substitute for a professional WCAG 2.1 audit or legal compliance review. Results are indicative, not authoritative.

Intellectual Property

• Your content — you retain ownership of the URLs, screenshots, and any content you submit for scanning. You grant us a limited license to process and store that content for the purpose of providing the service.
• Our technology — TestHawk's scanning technology, algorithms, report formats, and brand are proprietary to Polsia, Inc. You may not copy, modify, or redistribute them.
• Your reports — scan reports generated for your account are yours to use for your internal purposes. Sharing reports publicly is permitted. Reselling reports as a standalone product is not.

Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• TestHawk is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of revenue, data, or business opportunities.
• Our total liability for any claim arising from your use of TestHawk shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for the actions of third-party websites you scan — their content, security, or compliance status is their responsibility.

Account Termination

• By you — you may close your account at any time from the dashboard settings or by emailing hello@testhawk-2.polsia.app.
• By us — we may suspend or terminate your account immediately if you breach these terms, abuse the service, or fail to pay fees.
• Upon termination, your scan data is retained for 30 days before permanent deletion (see Privacy Policy).

Changes to These Terms

We may update these terms from time to time. If the changes are material, we will notify you by email at least 30 days before the new terms take effect. Your continued use of TestHawk after the effective date constitutes acceptance of the updated terms.

The "Last updated" date at the top of this page reflects the most recent revision.
